Forty-three-year-old Randy Barrack, of Lot 34 Albouys Street, Albouystown, Georgetown, was on Friday re-arraigned before Georgetown Magistrate Leron Daly on two counts of assault and one count of simple larceny allegedly committed on July 2 last.
On his first arraignment, Barrack had denied all the charges, and the simple larceny matter against him had been discharged after the virtual complainant had refused to give evidence.
The Police prosecutor, however, had asked that the parties involved in this matter be subjected to a $10,000 fine for wasting the court’s time.
In regard to the two counts of assault, for which he was being re-arraigned on Friday, the Police contention was that on July 2, 2018, with intent to prevent lawful apprehension, Barrack assaulted Police Constables Mark Griffith and Ryan Pollard who had gone to his home to arrest him in connection with an alleged robbery committed on Cindy Ramnaresh.
In the process of the constables effecting his arrest, Barrack reportedly refused to be arrested, and dealt the constables several lashes instead.
Police Prosecutor Sanj Singh objected to Barrack being placed on bail, informing the court that Barrack had previously been arraigned on a charge of possession of firearm without being the holder of a licence thereof.
Barrack’s attorney, however, explained that on the day in question, his client was mourning the loss of a family member, and had asked the constables for some time.
The constables, he said, had become outraged and attempted to forcefully arrest Barrack, during which a scuffle ensued between the men, and the constables were allegedly assaulted.
Barrack was eventually placed on $100,000 bail for the assault charges. The matter will continue on October 2.
