Court denies Balwant Singh Hospital’s Injunction against “Melly Mel”
The High Court on Wednesday threw out a request by the Balwant Singh’s Hospital to prevent Women’s Rights and Social Activist, Melissa Atwell also known as “Melly Mel” from sharing horror stories of pregnant women who were patients at the private institution.
In addition, Justice Fidela Corbin also disallowed the Hospital’s request for the experiences shared by the activist be removed.
These were denied by the Judge on the grounds that the private medical institution failed to prove whether or not the stories shared on the social media platform were factual.
Atwell had a $100 million law suit filed against her for tarnishing the Hospital’s reputation via social media posts.
The applicants (Balwant Singh Hospital) through their lawyer, Devindra Kissoon made an application of injunction to the High Court against the Activist who is being represented by attorneys Sanjeev Datadin, Ganesh Hira, Donavon Rangiah and Anessa Chow.
The matter came up for hearing on Tuesday for the first time in the High Court.
The private health institution is suing for; libel damages for no less than $5 million; special damages for no less than $100,000 and aggravated and exemplary damages for no less than $5 million, all to be determined at a trial.
Atwell, has maintained her innocence, in addition, with promising to take actions against the applicant and the Guyana Police Force, for her wrongful detainment and harassment as she claims that posts made on her Facebook page can be proven, and her personal computer is still in police custody.
Based on the hospital’s claims, Atwell was questioned extensively about her social activism and locked up for over 12-hours without charges.
Atwell was placed on $200,000 station bail.
