The GFC was notified of the appointment of the embattled deputy Commissioner as Commissioner (ag).
It has been noted in KN article January 4, 2020, that several criteria should be in place or the person holding the office must meet certain requirements. Most importantly, also, is the Minister’s approval of the person. The GFC Act 2007 outlines that legal requirement and clearly, this appointment is alleged to be in breach of the Act and can be considered null and void.
The Government, being defeated by a No-Confidence Motion in December 2018, placed in a caretaker mode, and Parliament having been dissolved, the Minister and Board authority to make such an appointment are obviously restrained.
Notwithstanding it is alleged that staff have pledged their full support for the caretaker and interim Commissioner.
