Full Court stops recount case

The Full Court, comprising of acting Chief Justice Roxane George and Justice Nareshwar Harnanan, this morning granted a “stay” prohibiting Justice Franklyn Holder from proceeding with the commencement of the trial of the case blocking the Guyana Elections Commission (GECOM) from recounting the ballots cast in the March 02 General and Regional Elections.

The Full Court heard the appeal against Justice Holder’s decision that he has jurisdiction to hear the case. A decision is expected to be handed down on Tuesday and will pave the way for the commencement of the trail or will see the case being thrown out.

Caretaker President David Granger sought the intervention of CARICOM in supervising a national recount of the ballots, a move which was supported by the Leader of the Opposition and GECOM. However, days after CARICOM fielded a high-level team to supervise the recount, a candidate on Granger’s list moved to the Courts to block the recount.

The injunction was granted by Justice Holder which resulted in the process being stalled and the CARICOM team leaving.

Granger expressed his disappointment while CARICOM Chair, Barbados Prime Minister Mia Amor Mottley said “it is clear that there are forces that do not want to see the votes recounted for whatever reason.”
