Man jailed for raping 4-year-old

Twenty-eight-year-old Dwayne Hamilton, who was found guilty of raping a four-year-old, was on Friday sentenced to 12 years in prison by Justice Jo-Ann Barlow for the act which was committed on February 21, 2007.
The accused was found guilty of the offence on March 20, 2019, by a 12-member jury at the High Court but was sentenced on Friday after his lawyer had made a request for a probation report to be presented.
Justice Barlow during her sentencing explained that the only mitigating factor existing is that Hamilton was 16 years old when he committed the act, and thus metred a 12-year sentence against him.
After the sentence was handed down, Justice Barlow recommended that during his time in prison Hamilton be exposed to counselling sessions, while advising him to participate meaningfully in same which would help reform him to be a part of society again after serving his time.
The accused was represented by Attorney Ravindra Mohabir while the State’s case was presented by Prosecutors Lisa Cave, Seeta Bishundial and Sarah Martin.
The court heard that the accused committed the act on the child moments after she had used the washroom. The accused, who was 16 at the time, was caught in the act by the child’s mother, who immediately reported the matter to the police. He, however, managed to evade the police but was eventually caught.
