NICIL secures court order for 315 acres of land on Corentyne
The National Industrial and Commercial Investments Limited (NICIL) has won a case it had been pursuing in court, securing an order for 315 acres of land at Plantation Clifton and Johns on the Corentyne Coast.
According to the order, which was issued by High Court Judge Fidela Corbin-Lincoln, the respondents are now mandated to deliver vacant possession of 315 acres of land at Plantation Clifton and Johns, by September 19, 2022.
“This court further orders that thereafter the respondents, their servants and/or agents are restrained from entering, occupying, encumbering or in any other way encroaching and or interfering with the applicant’s rights, use, enjoyment, occupation and/or possession of immovable property known as all that piece or parcel of land containing an area of approximately 315 (three hundred and fifteen) acres more of less part of plantation Clifton and Johns situated on the Corentyne Coast, in the County of Berbice, Guyana.”
Additionally, the court ordered that each of the respondents pay NICIL damages in the sum of $10,000 and costs in the sum of $25,000. The respondents in the case are Kalamodian Haniff; Asheem Ali; Mohamed Ali Khan; Chandradat Ramotar; Azeez Ali Khan; Dularie Kunjebhari; Dianand Jhando; Syjit Kumar Ramotar and Lekhram Jagit.
The fixed date application was filed on October 11, 2021, by NICIL Company Secretary Arianne McClean. The ruling was made after the Judge would have read the submission on behalf of the applicant and the respondents.
NICIL, as a State enterprise, is the custodian of large tracts of land throughout Guyana. It has also been involved in a number of court cases throughout the years where it would have had cause to reclaim land. (G3)
